Imran Khan Wins Major Court Relief

The Islamabad High Court (IHC) has issued a detailed ruling on petitions challenging the alleged solitary confinement of former prime minister and PTI founder Imran Khan and his wife Bushra Bibi, directing Adiala Jail authorities to ensure that neither prisoner is kept in solitary confinement.

Justice Khadim Hussain Soomro announced the reserved verdict after hearing petitions filed by Imran Khan’s sister, Aleema Khan, and Bushra Bibi’s daughter, Mubashra Khawar Maneka. The petitions had challenged the alleged isolation and restrictions imposed on the two prisoners at Adiala Jail.

Imran Khan Solitary Confinement Ruling

In its detailed judgment, the IHC directed the superintendent of Adiala Jail to ensure that Imran Khan and Bushra Bibi are not subjected to solitary confinement.

The court also directed authorities to facilitate a meeting between the two in accordance with applicable prison rules. The ruling further instructed jail officials to restore family access for Imran Khan under the relevant jail regulations.

The decision follows months of legal proceedings over claims that the couple had been subjected to prolonged isolation. During earlier hearings, jail authorities and the Islamabad Advocate General had denied that either prisoner had formally been placed in solitary confinement, arguing that separate accommodation was linked to security considerations.

Family Meetings and Phone Calls

The court ordered that Imran Khan be allowed to meet his family members according to jail rules.

It also directed authorities to facilitate telephone conversations between Imran Khan and his sons. According to the detailed judgment, the facility can be suspended if communication is recorded or used for political campaigning in violation of the court’s conditions.

The ruling represents a significant judicial direction concerning the former prime minister’s access to family and communication while in custody.

Books, Newspapers and Medical Care

The IHC also directed jail authorities to provide Imran Khan with newspapers and books on a daily basis.

The court ordered that books supplied by petitioners should be provided after the required security checks. The judgment additionally addressed access to other facilities, including medical care and daily physical activity in accordance with prison rules and medical recommendations.

The court emphasized that security considerations could not be used as a blanket justification for depriving a prisoner of basic human interaction and communication.

Authorities were also instructed to provide Imran Khan with medical facilities in accordance with applicable prison rules.

Legal Basis of the Court’s Decision

The Islamabad High Court held the petitions maintainable with reference to principles established in the Begum Nusrat Bhutto and Begum Shamim Afridi cases.

The ruling followed extensive proceedings in which the court sought reports from jail authorities and examined the legal basis for the alleged restrictions.

Earlier, the court had noted that solitary confinement was not imposed as a punishment in the relevant National Accountability Bureau convictions and had sought clarification from prison officials regarding the nature and legal basis of the arrangements at Adiala Jail.

Adiala Jail Ordered to Submit Report

The IHC has instructed the Superintendent of Adiala Jail to ensure implementation of its directions.

The jail authorities have been ordered to submit a compliance report within 15 days, documenting the steps taken to implement the judgment.

The ruling brings a significant development in the ongoing legal debate over the treatment and conditions of detention of Imran Khan and Bushra Bibi.

While the judgment does not alter their underlying convictions or sentences, it establishes specific directions concerning their treatment, family access, communication, reading material and medical care while in custody.
